Dinnerkin Terms of Use
Last updated: [DATE]
These terms are an agreement between you and [COMPANY NAME] (company number [COMPANY NUMBER], registered office [ADDRESS], contact [CONTACT EMAIL]) ("we", "us"). They cover your use of the Dinnerkin app and service. Please read them with our Privacy Policy and Allergen & Health Notice.
Summary: Dinnerkin plans family dinners and shopping lists. Subscriptions are sold and billed by Apple or Google and renew automatically until you cancel in your store settings. Refunds are handled by Apple or Google. You must always check food labels for allergens. Your legal rights as a consumer are not affected.
1. Who can use Dinnerkin
You must be 18 or over and live in the UK to create an account and subscribe. You are responsible for the household information you enter, including information about other people (see our Privacy Policy, section 3.2).
2. What Dinnerkin does
Dinnerkin suggests weekly dinner plans, recipes and shopping lists based on the supermarket, budget, equipment and dietary settings you give us.
- Prices and savings are estimates. Prices come from public sources and may be out of date. They vary by store, location and promotion. We do not guarantee the cost of your shop.
- Product availability in your chosen supermarket is not guaranteed.
- Supermarket names are trade marks of their owners. Dinnerkin is not affiliated with, or endorsed by, any supermarket.
- Allergens and diets: we filter recipes using the information you give us, but we cannot guarantee that any meal is free from an allergen. Always read product labels. See our Allergen & Health Notice. Dinnerkin is not medical or dietetic advice.
3. Subscriptions
3.1 Plans and prices
We offer [an annual plan and a weekly plan]. The price, billing period and any free trial are shown in the app before you subscribe and on the Apple or Google payment sheet. Prices include VAT where applicable.
3.2 Who you pay
You buy your subscription from Apple (App Store) or Google (Google Play), using the payment method in your store account. Apple's or Google's terms also apply to the purchase:
- Apple Media Services Terms: https://www.apple.com/uk/legal/internet-services/itunes/uk/terms.html
- Google Play Terms of Service: https://play.google.com/about/play-terms/
We never see or store your card details.
3.3 Free trial
New subscribers may get a free trial of [3] days. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you will be charged [£X] for [one year / one week] on [the date shown on the paywall]. We will send you a reminder [24 hours] before your trial ends: a push notification, or a message in the app if notifications are off. You can get one free trial per [Apple / Google account]. ⚠️ Confirm the "24 hours" cut-off matches Apple/Google behaviour.
3.4 Automatic renewal
Your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the period ends. Your store charges you within the 24 hours before renewal.
3.5 Price changes
If we raise the price of your subscription, Apple or Google will tell you in advance and, where the store requires it, ask for your agreement. If you do not want to pay the new price, you can cancel before it applies.
3.6 How to cancel
Cancel in your store account, not in the app. Deleting the app or your Dinnerkin account does not cancel your subscription.
- iPhone/iPad: Settings → [your name] → Subscriptions → Dinnerkin → Cancel Subscription.
- Android: Google Play app → profile icon → Payments & subscriptions → Subscriptions → Dinnerkin → Cancel.
The app has a Manage subscription link that opens these pages. After you cancel, you keep access until the end of the period you have already paid for, or the end of your free trial.
3.7 Refunds
Purchases are processed by Apple or Google, so refund requests must go to them:
- Apple: https://reportaproblem.apple.com
- Google: https://support.google.com/googleplay/answer/2479637
We cannot issue refunds directly. If you have a problem, contact us at [CONTACT EMAIL] and we will help where we can.
3.8 Your right to cancel (14-day cooling-off)
UK consumers usually have 14 days to cancel a distance contract. For your first subscription, that period starts when the contract is made.
- If you start using paid features straight away, you agree that the service begins during the cancellation period. ⚠️ Depending on how the app is classified (see drafting note 2), you may then lose the right to cancel or have to pay for the service already provided.
- Apple's UK terms let you cancel within 14 days of receiving your receipt through "Report a Problem" / "Withdraw Transaction". Google Play has its own UK refund rules. These store rights apply in addition to these terms.
3.9 Family Sharing
If you subscribed on iOS and turned on Family Sharing, members of your Apple family group may also use the subscription, under Apple's rules.
3.10 Restoring purchases
If you change device, use Restore purchases in the app while signed in to the same Apple or Google account.
4. Your account
Keep your sign-in secure. You can delete your account at any time in Settings → Delete account. This deletes your data as described in the Privacy Policy, but it does not cancel your subscription (see 3.6).
5. Acceptable use
Do not misuse the app. In particular, do not try to break its security, scrape our recipes or data, reverse-engineer it (except where the law allows), resell access, or use it in a way that breaks the law.
6. Our content
Recipes, photos, text and software in Dinnerkin belong to us or our licensors. You may use them for your own household and non-commercial purposes. Please do not republish them.
7. Changes to the service and these terms
We may update the app, add or remove features, and change these terms, for example to reflect legal changes. If a change significantly affects you, we will tell you in advance. If you do not agree, you can cancel your subscription. We will not make changes that reduce the core service you have paid for during a paid period, unless the law requires it or we refund you ⚠️ (confirm the mechanism, because refunds go through the stores).
8. If something goes wrong: our responsibility to you
- If the app or a recipe is faulty or not as described, you have legal rights under the Consumer Rights Act 2015. Digital content must be of satisfactory quality, fit for purpose and as described, and services must be provided with reasonable care and skill. Nothing in these terms affects these rights. Citizens Advice can explain them: https://www.citizensadvice.org.uk/consumer/.
- We are responsible for loss or damage that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
- We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be excluded.
- We are not responsible for business losses (the app is for personal use only), or for losses caused by events outside our reasonable control.
- Allergens: we rely on the information you enter and on product information that manufacturers can change. Read our Allergen & Health Notice. ⚠️ Have a solicitor review how far liability can be limited here. Under CRA 2015 s.65, liability for death or personal injury from negligence cannot be excluded.
9. Ending these terms
You can stop using Dinnerkin at any time. We may suspend or close your account if you seriously or repeatedly break these terms. If we close the service entirely, we will give you at least [30] days' notice and help you get a refund for any unused paid period through Apple or Google where possible ⚠️.
10. Apple-specific terms
If you downloaded Dinnerkin from the App Store: these terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation. Apple is not responsible for product claims, legal compliance claims or third-party IP claims about the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. ⚠️ This is the minimum Apple requires in a custom EULA. Alternatively, use Apple's Standard EULA and treat these terms as supplementary.
11. Complaints and law
Contact us first at [CONTACT EMAIL]. We aim to reply within [5] working days.
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts, and the mandatory consumer laws of your home nation still apply.
